The United States Court of Appeals for the 9th Circuit recently made the determination in the opinion posted below, that Counsel Press fees maybe be recovered as a “taxable cost” because they are normal out-of-pocket expenses. This opinion was issued in a 42 U.S. C. § 1988 action, where attorneys fees are recoverable. This decision may not necessarily stand for the broader conclusion that fees for our services (or vendor fees) are recoverable as costs in cases where attorney fees are not recoverable by statute.
Relevant language, from page 12 of the opinion:
“Moreover, an award of reasonable attorney’s fees under 42 U.S. C. § 1988 may include outside vendor expenses for filing, electronic filing, and preparing tables, as long as the expenses are customarily billed separately to fee paying clients.”
